If you look at Omni actually can use either fake pubkey, multisig (not sure P2SH or P2MS) or OP_RETURN. Chain split is very unlikely because BIP 110 require 55% mined block threshold, unless they changed it to activate it regardless of how many miner support it. But if there was an actual chain-split, what would do you believe will those miners who pointed hash power to Ocean Mining pool would do? Continue mining a worthless chain or start pointing their hash power to Luck8 Dev? Some miners might not care right now about what's going on with the BIP110 sybil talks, as long as revenue block reward is coming, their intentions will be remain unknown for now but if at some point in the future there is a chain split, they are going to leave for other mining pool if it's not profitable mine their shitcoin. Ocean pool practically support BIP110 signal, it's even possible that miners in that pool might as well support BIP110 signal. I don't trust that mining pool, the founders has an organized relay policies for transactions that fit their description of what blocks should have and what shouldn't be in blocks, they might as well not welcome who isn't interested in their policies.
